By accessing our website or purchasing our wellness programs for office workers, you agree to be bound by these terms. If you do not agree, please do not use our website or services.

These documents together form the agreement between you and Strainingearth regarding our office wellness offerings.

Strainingearth provides structured wellness programs designed for office workers and desk-based teams. Our services focus on movement routines, posture awareness, ergonomic guidance, and workplace habit formation. Programs are delivered on-site at client offices, virtually for hybrid teams, or at our Wellington studio by trained facilitators.

Program descriptions, pricing, and inclusions on our website are provided for informational purposes. Final terms for each engagement are confirmed in a written proposal or service agreement at the time of booking.

4. Eligibility and Account Responsibility

Our services are intended for organisations and individuals aged 18 years or older. When you submit an enquiry or purchase a program on behalf of an organisation, you represent that you have authority to bind that organisation to these terms. You are responsible for ensuring that all information you provide is accurate and current.

5. Booking and Payment

Program bookings are confirmed upon receipt of payment or signed agreement as specified in your proposal. Prices are listed in New Zealand Dollars (NZD) and include GST where applicable. We reserve the right to update pricing on our website; however, confirmed bookings will honour the price agreed at the time of purchase.

Payment methods and due dates will be communicated during the booking process. Late payments may result in session postponement until outstanding amounts are settled.

6. Program Delivery

Strainingearth will make reasonable efforts to deliver programs at agreed times and locations. Clients are responsible for providing suitable space for sessions, notifying staff of scheduled times, and ensuring minimum participation requirements are met where specified in the program package.

If a client cancels or reschedules with less than 48 hours notice, a rescheduling fee may apply. Facilitator no-shows or service failures attributable to us will be remedied through rescheduling at no additional cost or a proportional refund as outlined in our Return Policy.

All content on strainingearth.world including text, graphics, logos, program structures, Movement Lab methodologies, and Program Materials is owned by or licensed to Strainingearth and protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

Clients receive a limited, non-exclusive licence to use Program Materials internally for the duration and scope of their purchased program. This licence terminates upon completion of the program unless otherwise agreed in writing.

Our workplace wellness programs are educational and facilitative in nature. They are designed to support general wellbeing, movement awareness, and ergonomic habits among office workers. Strainingearth does not guarantee specific outcomes for any individual or organisation.

Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by New Zealand law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Participation in wellness sessions is voluntary. Individuals with pre-existing physical conditions should consult an appropriate health professional before participating and inform our facilitators of any relevant limitations.

10. Limitation of Liability

To the maximum extent permitted by the Consumer Guarantees Act 1993 and other applicable New Zealand legislation, Strainingearth shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including loss of profits, data, or business opportunities.

Our total liability for any claim arising from a specific program purchase shall not exceed the amount paid by the client for that program. Nothing in these terms excludes or limits liability that cannot be excluded or limited under New Zealand law.

You agree to indemnify and hold harmless Strainingearth, its facilitators, employees, and contractors from any claims, damages, losses, or expenses arising from your breach of these terms, misuse of Program Materials, or failure to provide a safe environment for session delivery.

You agree not to use strainingearth.world for any unlawful purpose or in any way that could damage, disable, or impair the website. Prohibited activities include attempting unauthorised access to our systems, transmitting malware, scraping content without permission, or using automated tools to access the site in a manner that exceeds reasonable use.
